| Court awards 10 years RI, one lac fine to Narco Smuggler | | | Early Times Report
JAMMU, November-11 (JNF):- Third Additional Sessions Judge Jammu Pawan Dev Kotwal today convicted and sentenced Zahoor Ahmed s/o Ghulam Hussain r/o Khadoli Tehsil & District Kulgam from whom Charas weighing 4.5 KG was recovered and awarded 10 years rigorous imprisonment and fin Rs 1 lac u/s 20 (b) (II) (c) of Narcotics Drugs and Psychotropic Substances Act 1985.
According to the prosecution case that on January 15, 2009 a police party on patrolling duty at Smadian Road apprehended Zahoor Ahmed and from his search charas was recovered and a case was registered under NDPS Act. After completion of investigation challan was presented in the Court.
The court after hearing Additional Public Proseuctor Gulzar Singh Charak for the state, accused who was in the court in custody along with counsel observed that in this case Court is of the considered view that the evidence adduced by the prosecution is creditworthy and does not suffer from material infirmity or in consistencies and therefore prosecution has succeeded in establishing behind every of shadow of doubt that 4.5 KG of Charas was recovered from the possession of accused. The quantity of charas recovered is commercial and thus accused is held guilty for possessing commercial quantity of charas and awarded 10 years rigorous imprisonment and fine Rs 1 lac. JNF
