SC to hear MCD application on deferment of sealing on Nov 6

New Delhi, Nov 3 The Supreme Court will hear on Monday

another application filed by the MCD seeking deferment of the

resumption of sealing of over 40,000 shops in the capital whose
owners have filed affidavits giving an undertaking to the court that
they would stop the misuse by June 30.

The MCD counsel today mentioned the matter before a Division Bench
comprising Justice K G Balalkrishnan and Justice Lokeshwar
Singh Panta for an urgent hearing of their applications to be filed
during the course of the day.
The MCD is seeking postponement of the sealing operation on the
grounds that the law and order situation was not conducive at
present for starting the process and the situation may go out of
hand in view of the widespread resentment brewing among traders
against the sealing.
The MCD also pleaded that lakhs of employees working in these
commercial establishments may also be rendered jobless, causing
distress to their families.
The court directed that the application, if filed today, would be
heard on Monday along with other applications filed by by the Centre
as well as the Delhi Governrment subject to the convenience of the
Chief Justice.
Even the Supreme Court appointed monitoring committee has also
requested the court to postpone the sealing for sometime in its
report filed in the apex court, meaning therby that all the
government agencies -- the Centre, Delhi governrment, MCD, Delhi
Police as well as Monitoring Committee -- are in favour of deferring
the sealing process.
The Monitoring Committee report is based on the one of the Delhi
Police, MCD, Group of Ministers, as well as the feedback from
Intelligence Bureau.
