Court denies bail to approver in Pukharpur Encounter Case

JAMMU, November: 15 (JNF):- Principal Sessions Judge Jammu AK Shan dismissed the bail application of Waris Gill approver in the much publicized Pukharpur Encounter case in which the members of the SOG allegedly kidnapped and brutally tortured Mohd Ayub Dar a 17 years old boy which resulted in the death of deceased.
In order to conceal the death of deceased in the camp, the accused hatched criminal conspiracy with approver Waris Gill and to fabricate the story that the deceased was killed in encounter, accordingly, the dead body of the deceased was shifted in Gypsy by the accused towards Charare Sharief and on reaching near nursery at Dhalwan both the accused brought out the dead body of the deceased and sprayed bullet on it. Accused Ichapal Singh, fired shot on his own leg resulting in injury. This fake encounter was managed to screen themselves from offence of murder of deceased.
On a newspaper report published on June 6, 1999 the State Human Right Commission took suo-moto cognizance and order for registration of case. The case was registered and after completion of the investigation challan was presented in the Court and the Principal Sessions Judge Budgam framed charges against the accused persons 302/342/201-120-B RPC. The accused persons filed a petition in the State High Court for transfer the case, the State High Court transferred from Budgam to Srinagar which was again filed SLP in the Supreme Court; the Supreme Court transferred the case from Srinagar to Jammu.
The approver filed this application for bail on various grounds; Court dismissed the same whereas the approver also filed application for shifting him to District Jail Rajouri till the statement is recorded. Court also dismissed this application as not maintainable. JNF
