They misuse freedom of speech for preaching sedition
11/16/2010 11:25:34 PM
If not anything else the separatists and the fundamentalists have succeeded in exploiting freedom of speech,as enshrined in the constitution of Inia, for propagting what experts call sedition.Preaching sedition, spreading communal virus and hatred under the garb of freedom of speech has remained an essential feature of the democracy that India and the Indians boast of as their political ornament, more valuable than any precious metal. And despite repeated attempts by those who feel incensed over the freedom separatists and fundamentalists enjoy in propagating sedition at raising the issue in the courts and in the Parliament and the state legislatures the law that prohibits or that provides for a strict penalty for those preaching sedition has hardly been enforced. The result is that day in and day out political leaders, besides goons of various hues, are seen violating the law that prohibits propagating sedition or for sowing seeds of communal hatred. And not surprisingly the issue of firm action against those preaching sedition came up in the Delhi High Court where a petitioner filed an application seeking court directive to the Delhi Government for initiating criminal proceedings against kashmiri separatists,Syeed Ali Shah Geelani, writer and human rights activists,Arundhati Roy and S.A.Geelani,a Delhi University professor. While the Court was requested to direct the Delhi Government to take action against Geelani,Roy under section 124-A IPC,others have stated that freedom of speech never includes freedom of propagating ideas against national interest. They want firm steps against those misusing freedom of speech for provoking people. In this connection the Court was told that the statement given by Arundhati Roy that Kashmir is not an integral part of India was sufficient to provoke people to violence. She committed a bigger violation of freedom of speech when she exhorted youth of Jammu and Kashmir to make sacrifices for Kashmir.Political experts are of the firm opinion that Government inaction against those propagating sedition had encouraged separatists and fundamentalists for propagating sedition and communal virus and hatred.Whatever political malady exists in India it is the result of blatant misuse of freedom of speech. Not only this even various political, economic and social offences go unpunishd in India. The result is that India has not been able to contain the menace of hoarding, profiteering, sex abuse, extortion of different nature, murders, rapes etc.Compare India with some Islamic countries, including Egypt and Saudi Arabia where for a theft or a robbery the criminal's hands are chopped off.It can happen only in Egypt and not in India that profiteers are flogged to death in presence of a large crowd. And it is because of the unlimited freedom of speech that even known enemies of India have been inciting separatists and militants in Jammu and Kashmir and Maoists and Naxals in north-eastern region to violence and to preaching sedition. It is but natural that when a political criminal or an offender in the sector of economy feel that they will not be caged by the Government if they preacheed sedition or committed grave economic offences they have no reason to think twice before they commit the crimes. And had the Government strictly differentiated between the freedom of speech and freeedom to propagate sedition separatists and fundamentalists would have not dared to raise their head.Even if Pakistan claims to be supporter of freedom of speech those seeking independence in Sindh and Baluchistan provinces usually prefer an underground activities because of fear of repression but there is no such scare in India.Freedom for propgating sedition may ultimately lead to political chaos and disturbed security scenario in India.
