HC dismisses petition seeking appointment as ReT

JAMMU, Nov: 20 (JNF):- The petitioner after about six year’s litigation has failed to get relief for her as the High Court dismissed her petition Sh.e is no longer entitled to any relief.
The petitioner Asha Devi filed this petition seeking direction to respondents to appoint her as Rehbar-e-Taleem teacher and further submitted that while advertisement notice May 5, 2000 issued by the respondent applications were invited from permanent residents of district Jammu for appointment as ReT teacher at Village Level in the District. The petitioner figured at serial No 1 in the panel but despite that she was not appointed. The petitioner made verbal requests but despite of that, her grievance was not redressed. But one Tripta Devi who was figuring at serial no.2 in the said panel came to be appointed in terms of an order passed by the High Court. The petitioner again made a request for appointment but despite the fact that two posts were lying vacant, the respondent instead of appointing the petitioner, issued a fresh advertisement notice dated November 22, 2002.
In the reply the respondents resisted the petition on the grounds that the selection was made in the year 2000 whereas the petitioner approached the Court in the year 2004, after noticing the judgment dated 25th of November’ 2003 passed in petition.
Justice Mansoor Ahmed Mir of J&K High Court Jammu Wing after hearing Advocate PS chandel for the petitioner whereas Deputy AG Neeru Goswami appeared for the state has gone through the case of the petitioner and also referred the judgments of the Supreme Court and observed that Admittedly, the Scheme has come to an end and in terms of blanket ban imposed by the Government vide order no. 1670-Edu of 2003 dated November 24, 2003 no appointment can be made against the post of General Line Teacher in terms of R.E.T and it is worthwhile to mention that the writ petition came to be filed after the imposition of the ban. This writ petition, as such, is not maintainable. With these observations Court dismissed the petition. JNF
