While rejecting the bail application Court after hearing Advocate Madan Lal for the applicants and Senior Prosecuting Officer Anil Dev Jamwal for the police observed that after hearing both the sides and gone through the facts and circumstances of the case. Although the charge-sheet against accused persons has been filed and even the charge against them have been framed today, but the examination of prosecution witness shall start from next date of hearing. As per the case of prosecution that the accused persons forcibly tied both the hands and the mouth of son of complainant namely Himanshu Gupta and thereafter robbed the complainant and their tenant of ornaments of gold, mobile phones and cash by putting the son of the complainant in immediate fear of death by placing a knife at his neck. It is worthwhile to mention here that the complainant and the one of the accused persons in present case are close relatives and that being so the contention of the senior public prosecutor that once the accused persons are admitted to bail. The chance of their willing over the witnesses either by way of undue influence or by intimidation is not. Court is of the opinion that there is every likelihood of prosecution evidence being tempered in case the accused persons are admitted to bail. With these observations Court rejected the bail application of all the accused persons who are facing trial u/s 392/34 RPC r/w section 4/25 Indian Arms Act.
