Court frames corruption charges against 6 officials of Agriculture Dept

JAMMU, Dec: 01 (JNF):- Additional Sessions Judge Anticorruption Jammu DC Sagotra framed corruption charges against Yog Raj Singh then Junior Agriculture Assistant now enforcement inspector, Rajinder Parshad Manhas then SDAO Doda, Daleep Singh then AEO Marmat Doda, Bahrti Thusoo then Junior Agriculture Assistant, Prithvi Raj Shan then SDAO Ramban and Abdul Rashid Khan then AEO Ramban u/s 5(2) J&K PC Act 2006 SVT r/w section 120-B RPC in case FIR NO 10/2003 P/S VOJ.
The case was registered on the outcome of preliminary enquiry conducted into the allegations misuse of official position by Yog Raj Singh and Bharti Thusoo then Junior Agriculture Assistants Doda and Ramban respectively, it was alleged that both the accused have unauthorizedly undergone M.SC Agriculture from Palampur University as regular candidates and have drawn their salaries in connivance with their drawing and disbursing officers for the period they remained regular student of the university. During the course of enquiry it was found that Yog Raj Singh has undergone M.SC Agriculture Course at Himachal Pradesh Palampur from August 97, to August 99 without obtaining Govt sanction and managed to draw Rs 1, 13, 594 as his salary for the period he remained as regular student of the University in connivance with his immediate supervisory officers RP Manhas then Sub Divisional Agricultural Officer Doda and Daleep Singh Agriculture Extension Officer Marmat, in this way he deceived the dept and also University. The enquiry also transpired that Bahrti Thusoo who already selected for M.SC Agriculture Course at Palampur on August 14, 1996 prior to her appointment in dept. On her selection she availed the opportunity to catch holds the Govt job and continued her studies in the university regularly.
Prithvi Raj Shan then Sub Divisional Agriculture Officer Ramban and AR Khan then Agriculture Extension Officer Ramban were in know of her studies but they never reported the matter to higher authorities, an amount of Rs 1, 15, 696 in the shape of salary was paid to Bharti Thusoo during her M.Sc Agriculture period. M/S RP Manhas, Dalip Singh were also found involved in drawing the salary of accused Yog Raj Singh as they drawn his pay illegally and gave attendance certificate to Yog Raj Singh. In this way accused persons misused their official position and cause hue loss to the state exchequer in furtherance of the criminal conspiracy with the beneficiary employees. The omission and commission on the part of accused persons constituted offences punishable u/s 5(2) J&K PC Act 2006 r/w section 120-B RPC and accordingly case was registered in the Police VOJ against above said accused persons and after completion of the investigation VOJ presented challan in the Court of Special Judge Anticorruption Jammu from where the case was transferred to Additional Sessions Judge Anticorruption Jammu.
Court after hearing Senior Public Prosecutor Rohit Gupta for the VOJ and Advocates for the accused persons observed that so far accused Yog Raj Singh is concerned his Advocate has concealed and has requested to the Court that charge be framed against him, so far as RP Manhas and Daleep Singh are concerned as per the record in the file accused Manhas has drawn the salary of accused Yog Raj Singh for the period August 1997 to August 1999 and has also disbursed him. So far accused Dalip Singh is concerned he has issued attendance certificate and is the same in the case of Bharti Thussoo and charges u/s 5(2) J&K PC Act 2006 SVT r/w section 120-B RPC farmed and directed evidence to produce the evidence on the next date of hearing.
