Misappropriation of foodgrains: Pre-arrest bail of TSO rejected | | | EARLY TIMES REPORT JAMMU, December 03: The 2nd Additional Sessions Judge VC Koul today rejected the pre-arrest bail of Kuldeep Singh, supervisor/TSO, CAPD posted at Katra Govt store against whom a case u/Ss 409/120-B RPC and 3/7 EC Act for misappropriation of wheat meant for the people belonging to BPL. Rejecting the pre-arrest bail of Kuldeep Singh, Court after hearing Additional Public Prosecutor KA Qazi and also gone through the police report revealed that a case under above mentioned sections stand registered against him and others with the P/ Nagrota. The applicant is supervisor/TSO in CAPD and is posted in Govt Store at Katra. As per the report he in pursuance of criminal conspiracy with other accused is involved in misappropriation of the Govt wheat meant for BPL category. The accused misappropriating said Govt property by taking same illegally from CAPD store Katra to his own flour mill at Patti Tehsil Samba and in this way he is misappropriating the Govt property entrusted to him and misappropriate the same to his personal benefits. Rejecting the pre-arrest bail application of TSO, 2nd Additional Sessions Judge, VC Koul observed that the provision of section 497-A CrPC has been incorporated in the CrPC to protect the innocent people from the unnecessary harassment of the police, but benefit of this section cannot be extended to such people who are prima-facie shown to have committed offence and that too of the nature, which is said to have committed by the appellant Kuldeep Singh. His arrest is required by the police for the purpose of his custodial interrogation and rejected the pre-arrest bail application. JNF
