| Officials of Konkan Railways Corp, Contractors in CBI net | | | EARLY TIMES REPORT
JAMMU, December: 04 (JNF):- CBI/ACB Jammu has registered a case in alleged bungling of more than 3.7 Crores in contract of dewatering work on Katra Laole section of Udhampur-Srinagar-Baramulla Railway Link Project.
According to the FIR that on reliable information that Konkan Railway Corporation Limited awarded contract for construction BG Single line tunnels on Katra-Srinagar Railway Link Project vide contract agreement dated February 16, 2004, the contract was awarded to M/S National Construction Corporation Limited Faridabad. The construction work was executed till July 25, 2007 of tunnel (t-3) which was thereafter suspended on account of some technical problems on the directions of Railway Board. In this contract the dewatering work was awarded to the same contractor @ Rs 6.457 per KWH in this way from January 28, 2004 to July 25, 2007 a total quantity of units consumed by M/S NPCCL was 384838.793 @ 24, 84, 81. 898/-. After the suspension of the work DK Mishra then Deputy CE (Tunnels) while posting as such during the period 2007-2010 awarded the contract dewatering to M/S NPCCL @54.40 per KWH in this way from July 25, 2007 to January 28, 2010 a total quantity of 658386 units was consumed @ 3,58,16,198. This work was awarded without calling for fresh tenders as required under rules. Similarly for the period January 29, 2010 to May 31, 2010 the dewatering work was awarded to M/S Nara Construction a sub-contractor of M/S NPCCL at the same rates of Rs 54.40 per KWH and during this period of a quantity of 117000 units was consumed @ 6376500/-. DK Misra Deputy CE (tunnels) awarded this work of dewatering without calling fresh tenders for the same. However, vide letter dated August 19, 2008 a committee comprising of M/S GK Jalan Deputy CE, Ishwar Chand Deputy CE, L Parkash Deputy CE and ML Bhagat Executive Consultant (electrical) Konkan Railways to analyze the rates of dewatering who calculated the same in an arbitrary manner @ Rs 54.40 per KWH. These rates were hypothetically recommended and approved by DK Mishra and the work was continued.
It is further alleged that no fresh tenders were floated for the work of dewatering which was adversely commented upon by the High Officers Konkan Railways, who had impressed upon for calling tenders and awarded work on regular basis, as the contract work carried at higher rates may lead to complexity. Thereafter, in March 2010 fresh tenders were called by the DK Mishra Deputy CE (tunnels) in which the rates per unit worked out 23.33 per KWH and contract was awarded to M/S NARA Construction, but later on the said allotment of contract was cancelled on the flimsy grounds.
According to the FIR that DK Mishra then Deputy CE (tunnels) Konkan Railways entered into criminal conspiracy with M/S NPCCL, M/S Nara Construction Reasi and Committee Members M/S GK Janal Deputy CE Kauri, Ishwar Chand Deputy CE Chenab/ Kauri, L Parkash Deputy CE HQ Reasi and ML Bhagat Executive Consultant (electrical) Konkan Railways with the object to cheat the Govt an drained out the Govt funds for the benefit of contractors and furtherance of this conspiracy, the work of dewatering was continued @ which 9 times higher then rate at which the work was carried out earlier. In this way a total loss of Rs 3, 71, 86,030 tentatively was caused to the Govt exchequer with corresponding gains to the contractors and a case against the abovementioned officers and. NKS Gahlot authorized representative of M/S NPCCL Fridabad, Mr. Surya Narayana Prop of M/S Nara Construction Reasi and after registration of the case U/S 120-B, 420 RPC and 5(2) r/w 5(1) (d) of J&K PC Act SVT 2006 and started investigation.
