Bhim Singh seeks justice for Katra Police assault victims | SC admits petition | | EARLY TIMES REPORT Dec ,14: The Supreme Court admitted a Special Petition of Ms. Anita Thakur, Mr. H.C. Jalmeria, Adv. & Mr. P.K. Ganjoo under Article 32 of the Constitution of India after hearing of the petition against the District Magistrate, Reasi (Mr. Varma), D.G. Police, I.G. Police, Jammu, then S.H.O.(Mr. S.S. Sambyal), A.S.I. (Mr. S.Pal Gill) and others for raining terror on the peacefully marching Talwara Migrants from Reasi to Delhi in support of their demands to implement Supreme Court Order of July, 2006 to provide them (Jammu Migrants) relief at par with the Kashmiri Migrants. A Division Bench comprising JJ Mr. S. Ravindran and Mr. A.K. Patanaik after hearing Prof. Bhim Singh appearing for the petitioners admitted the petition for hearing. Prof. Bhim Singh submitted that three years have passed since this petition was filed in the Apex Court. He quoted several orders of the Supreme Court in which the Court had directed for final hearing. Advocate-General of J&K appeared for the St ate and police officers. On August 7, 2007 while Talwara Migrants, mostly women and children were marching peacefully towards Delhi to seek the intervention of Prime Minister of India to ensure them justice by implementing Supreme Court Order to provide them relief at par with the Kashmiri Migrants, the police party headed by Additional S.P., Reasi and S.H.O. Katra charged the marchers with lathies and teargas-sells injuring several women and old men at Binie Bridge near Katra. According to the submission made, the police attacked the peacefully marching migrants at the Bridge. Advocate H.C. Jalmeria when approached the police to stop lathicharge, he was dragged by the police, beaten, abused and the police broke his leg leaving him on the road-side. When Anita Thakur tried to persuade S.H.O. Katra, S.S. Sambyal he attacked her followed by half a dozen policemen and women who started kicking, beating and then dragging her on the road by the hair for half a kilometer. This tragic event was screened in the court room at the request of Senior Advocate, Mr. K. Venugopal at the first hearing. Ms. Anita Thakur was taken to the police station, Katra by the S.H.O. by dragging her hair publicly. She was beaten inside the police station and subjected to humiliation by ASI, S.Pal Gill on the instruction of S.S. Sambyal. Mr. P.K. Ganjoo was detained in police lock-up Katra for three days. Prof. Bhim Singh informed the court that the police had acted at the instance of the power that be to demolish the democratic rights of the Panthers Party which has been fighting for equity and justice for the Jammu Migrants who have not been provided relief till date in spite of the Supreme Court orders. Prof. Bhim Singh submitted that Advocate H.C. Jalmeria, General Secretary of JKNPP has permanently become handicap whereas Ms. Anita Thakur has been suffering from several ailments and head injuries caused by police assault. The petitioners have also asked for compensation of Rs.10 lacs each for the illegal detention, assault and violation of their fundamental rights. The petitioners have sought dismissal and arrest of the named civil and police officers with appropriate punishment. Mr. B.S Billowria, Adv., Mr. D.K Garg, Mrs. Ritu Puri assisted Prof. Bhim Singh.
