| FIR registered against president of a charitable hospital, others on HC direction | | |
Jammu, November, 6:- In a writ petition filed by Monika Kakkar, Justice JP Singh of J&K High Court Jammu wing after hearing Advocate Nitin Bhasin appearing for the petitioner and Additional Advocate General Mr. BS Salathia disposed of the petition with a direction to police to consider the registration of FIR as and when an application moved by any of the relations of the petitioner disclosing the commission of a cognizable offence.
On the basis of High Court direction Monika Kakkar submitted an application for registration of a case against a Charitable Hospital situated at Amphalla Jammu, according to the application that the doctors and the management and other staff of the said hospital causing the death of the mother of the petitioner namely Mrs. Renu Kakkar w/o Lt Mr. Sunil Kakkar. It was submitted in the application that the mother of applicant (Mrs. Renu Kakkar Deceased) was working as Hostel Warden in an education Institution and was suffering from piles disease, she came to Jammu for medical check-up/ treatment, on reaching Jammu she came to know that Doctor of GMC Jammu had one on strike than the mother of applicant consulted a senior doctor of Charitable hospital on June 15, 2005, who is working as surgeon in the said Charitable hospital and is also a Rtd HOD Surgery Wing GMC Hospital Jammu, who advised the mother of the complainant for immediately undergoing piles operation which is according to him is a minor one. It is further submitted that an advance payment of Rs 10,000 was also charged from the mother of the applicant as operation fee, though the hospital is charitable one. It was further submitted that the hospital management on demand issued a receipt of Rs 6000/- only for remaining Rs 4000/- was not given. It is further submitted that the patient was not taken out of the operation theater even up to 12:00 Noon and when the applicant and her relatives enquire from the staff about the condition of the patient, the staff replied that the condition of the patient is stable and there is nothing to worry.
It is further submitted that at 1:30 PM the mother of the applicant taken out of the operation theater on a stretcher and was rushed to GMC Jammu. It is further submitted that it took more than 5 minutes for the ambulance to reach GMC Jammu but at about 1:40 PM the patient was declared dead by the hospital staff. It was alleged that the mother of the applicant had already died in the operation theater in Charitable Hospital but with malafide intentions and to save their skin after committing such an act, the deceased was shifted to GMC Jammu.
On this application and the copy of the direction of the High Court, the police registered a case against the management and the doctors of Swami Vivekanand Medical Mission Charitable Hospital Amphalla Jammu. |
