Minor Girl sold by mother seeking protection
HC directed SSP Jammu for registration of Case

Jammu, November, 6:- Justice YP Nargotra of J&K High Court Jammu wing in a writ petition filed by Pinki Devi age 14/15 years through her father Lali Ram, directed SSP Jammu to get the FIR on the report of Lali Ram natural Guardian of Pinki Devi registered in the Police Station in whose jurisdiction the cognizable offence, if any is found to have been prima-facie committed by any of the persons.



This court direction has been passed in a writ petition filed through Advocate AP Singh in which the grievances projected that Pinki Devi is a minor girl was in the custody of her parents till she attained the age of 8/9 years and after her mother Darshan Devi took her to Kot-Bhalwal, where she started living with Gusha Ram, about one year thereafter her mother and Gusha Ram sold her to one Inderjeet alias Madan Lal s/o Ganga Ram r/o Village Chibbe, Nagrota, where she was forced to do domestic labour and was also been sexually exploited.



According to petition that on October 25, 2006, the minor succeeded in escaping from the custody of Inderjeet alias Madan Lal and others and managed to reach back to the house of her father. After knowing the plight of the minor, her father approached the SHO P/S Poni Chak, but he refused to take any action in the matter. The petitioners are seeking a direction for providing protection to the minor, so as to save her from the clutches of Inderjeet and other respondents. Advocate AP Singh appearing for the petitioner submitted that he would satisfy if this peititon is disposed of with a direction to the concerned police station to register the FIR on the report of father of the minor girl and take appropriate action. Mr. AS Dogra Deputy Advocate General vice Mr. B S Salathia AAG while accepting notice for Home Department SSP Jammu and SHO P/S Poni Chak submitted that he would ave no objection to the grant of the prayer of the petitioners. After considering the statement of both sides Justice YP Nargotra disposed of this petition with the observation that in view of the submissions made this petition is admitted to hearing and disposed with the direction to SSP Jammu to get FIR registered.
