Court awards life-imprisonment to 3 murder accused | | | EARLY TIMES REPORT JAMMU, December: 23 (JNF):- The 2nd Additional Sessions Judge Jammu, Vinod Chatterji Koul today awarded life-imprisonment to three accused namely Ghara Ram, Jinder Pal and Puran Chand all are residents of RS Pura who are facing trial in a murder of one Rajneet Singh. According to the prosecution case on July 21, 2001 one Onkar Singh made an oral report with the Police Station, R.S. Pura athat on the said date, while he was on his way along with Gurmeet Singh from Jammu to their house when they reached in street in Ward-5 near the house of Puran Chand at about 9.30 PM, they heard cry “Bachao Barchao” and on hearing cry, he along with Gurmeet Singh went to that side and saw under the light of torch that accused Gharu Ram, Jinder Paul were carrying Tokas in their hands and accused Puran Chand was having Lathi and they in the furtherance common intention and conspiracy to kill Ranjit Singh deceased, inflicted injuries on him and he was lying near a drain in the street. The basis of the enmity that deceased’s illicit relation with the daughter of Puran Chand accused was in search of opportunity to eliminate Ranjit Singh. After completion of the investigation challan was presented in the Court of law. The court after hearing the parties convicted Ghara Ram, Jinder Pal and Puran Chand for having committed offence punishable u/s 302/34 RPC whereas accused Ghara Ram and Jinder Pal are also convicted u/s 4/25 Arms Act. On the quantum of sentence, the court observed that accused have been prosecuted for offence u/s 302/34 RPC and 4/25 Arms Act and considered the arguments of the counsels for the parties and aggravating circumstances of the case as pointed out on behalf of the accused. The punishment provided for the offence of murder under section 302 RPC is life imprisonment or death sentence. It is well settled that the life imprisonment is the rule and death sentence is an exception. Taking into the account the fact and circumstances of the case, age of the accused persons and the age of the deceased, sentence of life imprisonment appears to be adequate punishment and extreme penalty of death is not called for in the facts and circumstances of the case as the case does not appear to be rarest of the rare. Accordingly all the three accused namely Ghara Ram, Jinder Pal and Puran Chand are sentenced to imprisonment for life under section 302 r/w section 34 RPC. They are also fined Rs.2, 000/- each and in default of which they will under go simple imprisonment for a period of six months. accused Ghara Ram and Jinder Pal are further sentence to under go 1 year rigorous imprisonment u/s 4/2 5 Arms Act.
