| HC rescues husband booked for abducting wife | | | EARLY TIMES REPORT
JAMMU, Dec: 25 :- Justice Sunil Hali of J&K High Court Jammu Wing has quashed FIR lodged against one Muneer Ahmed who was booked for “kidnapped his own wife.”
The petitioner, Muneer Ahmed sought quashment of FIR NO 149/2009 dated August 3, 2009 u/s 363 RPC against petitioner. In the FIR it had been alleged that petitioner had kidnapped one Rubeena aged 17 years.
The petitioner submitted that he had married Rubeena on May 5, 2009. Nikhanama in this behalf was also executed. He further stated that they are living as husband and wife for the last more than one year.
The court after hearing the parties observed that allegation is that said Rubeena is minor seems to be believed. The petitioner has placed on record a certificate issued by the State Board of School Education, where date of birth of said Rubeena has been recorded as January 4, 1987. Thus it cannot be said that Rubeena is a minor. Therefore, continuance of the proceedings in the said FIR will only tantamount to harassing the petitioner. They are living as husband and wife for last more than one year. Court in this view allowed the petition and quashed the FIR registered against the petitioner in police post sarwal. JNF
