Court to hear election petition against Azad, Farooq | | | EARLY TIMES REPORT JAMMU, Dec 29: Single Bench of election tribunal headed by Justice Sunil Hali today announced that he shall hear Election Petition against Lal Singh (MP, Kathua), Dr. Farooq Abdullah, Ghulam Nabi Azad and others on regular basis. Justice Hali made this announcement after hearing advocates representing the respondents. Prof. Bhim Singh appearing for J&K National Panthers Party has challenged the election of Members of Lok Sabha and Rajya Sabha from J&K on legal grounds. He submitted before the court that election of four members of Rajya Sabha from J&K was held in 2009 through three different notifications to benefit the ruling parties. He said that purpose of Article 80 & 83 of Constitution of India stood defeated as the jurisprudence of ‘the single transferable vote’ was demolished by issuing separate notifications of four Rajya Sabha Members whose vacancies were created on the same day and they were elected on the same day for a period of six years. He said the law laid down by Delhi High Court in A.K. Walia case does not apply in the present situation as all MPs were elected who fall in the same category. On the request of several lawyers, the case was adjourned till December 31, 2010. Bhupender Singh Salathia, Subhash Goyal and others appeared for respondents. Ashok Vijay, Sham Sunder Lahar and H.C. Jalmeria appeared with Prof. Bhim Singh.
