HC dismisses Post master’s petition | | | EARLY TIMES REPORT Jammu, January: 04 (JNF):- A Division Bench of J&K High Court Jammu Wing comprising Justice JP Singh and Justice Sunil Hali today dismissed the petition of a Extra Departmental Branch Post Master, Ram Nath. Ram Nath was removed from service by the Supt of Post-office Udhampur dated March 29, 2001 after a departmental enquiry found him guilty of misappropriating the money of the depositors. He filed a petition before CAT which opined that the punishment awarded was harsh. It suggested modification of the punishment. However, the court observed that looking into the gravity of the misconduct of the petitioner in misappropriating the amount of the depositors, shaking the confidence of the depositors about the security of their money in the postal department, court does not find any ground warranting reconsideration of the petitioner’s punishment by the respondents for taking a lenient view and referred a judgment of the Apex Court. The court further observed that acquittal of petitioner in one of the similar misconducts for lack of evidence by the Criminal Court, would not in the view of this Court affect in any manner, the proved misconduct of the petitioner on the charges other than those which are subject matter of issue in the criminal court and dismissed the petition
