SC orders deportation of Pak prisoners Grants bail to Kashmiri militant

JAMMU, Jan 12: Division Bench of Supreme Court of India comprising Justice Aftab Alam and Justice R M Lodha today directed the Union of India and State of
J&K to file status report on the trial of 22 prisoners who are being tried in different courts order under various offences. The Apex Court also directed the state of J&K to file affidavit if it is prepared to conclude trial in J&K of those cases where Indian citizen from J&K or co-accused with foreigner accused. This issue came in connection with
Writ Petition of Prof. Bhim Singh, Chairman of State Legal Aid Committee.
Prof. Bhim Singh filed Writ Petition in 2005 challenging illegal detention of nearly 124 Pakistanis and others who were languishing in different Jails in India under PSA from several years without trial.
Three other Petitions were also filed in the Supreme Court since 203 for the release of over 200 foreigners including Pakistanis detained under PSA of J&K. More than 200 Prisoners from POK, Pakistan,
Afghanistan, Lebnon, Jordon etc have already been deported under Supreme Court order. The SC also directed the Union of India to file reply about the status of 64 Prisoners from POK and Pak who were recommended by J&K Govt. in 2006 to be deported as there were no cases pending against them. Gopal Subramaniam SG informed the Apex Court that seven out of 64 were facing trial.
Prof Bhim Singh strongly protested against the mutilation of human right by J&K government and said that this case of 64 prisoners challenged in different petitions was a giving example. The Apex
Court appreciated Prof. Bhim Singh efforts to take up these cases for a human cause. Supreme Court also ordered the release of Riaz Ahmed
Hazi on bail from Varanasi who has been in Varanasi Jail for the past one year being co-accused with a Pakistani Syed Ali Bukhari who’s case was shifted from Srinagar to Varanasi in November 2008. Riaz Ahmed
Hazi’s bail was rejected by Allahabad High Court.
