| Police Constable approaches High Court for illegal custody, torture | | | Jammu, Nov 08 A Head Constable of Jammu and Kashmir Police has approached the High Court of Jammu and Kashmir alleging that he was arrested by the police and brutally tortured in custody on false and frivolous charges. Through the medium of a writ petition, Head Constable Pardeep Kumar has demanded initiation of a departmental enquiry against Senior Superintendent of Police Mukesh Singh, Nasir Ahmed, and Deputy Superintendent of Police, District Police Lines and Pritam Singh, Deputy Superintendent of Police, District Special Branch Jammu for the conduct. Besides praying for the payment of compensation, the petitioner has also sought the intervention of the court in the return of some valuable items allegedly seized by the police from his house. The petition filed through Advocate Rahul Pant and SK Shukla, claim that on September 14, 2006 at around 11:30 PM the petitioner was arrested by a police team led by Nasir Ahmed Dy SP from his residence and taken to Quarter Guard in District Police Lines, Jammu. It was alleged that the petitioner was subjected to third degree torture in the custody by the respondents and some valuable items including gold ornaments were seized by the police from the residence of the petitioner at the time of arrest. The petitioner further alleged that though initially no reason of arrest was given to him he later came to know that he was being charged for the alleged issuance of fake appointment of SPOs. Claiming that he was transferred from SDPO South Office to Police Help Site, the petitioner argued that his job was to deal with the service verification and NOCs as such question of his role in the issuance of fake appointment orders does not arise. It was further alleged that the petitioner was kept in illegal confinement and handcuffed for several days inside the police cell at Quarter Guard. It was claimed that while the petitioner was in the illegal confinement of the police, a departmental enquiry was initiated and even completed without providing any opportunity to the petitioner of being heard. As per the counsel of the petitioner, the High Court has issued notice to the state and Director General of Police besides other respondents, after hearing him in the court. |
