JAMMU, Jan 14: The statement made by the Chairman and his suggestion just cannot be overlooked, as they constituted a reflection on the approach the Commission was likely to adopt during the course of investigation. It hardly matters whether he made such a statement in his capacity as head of the State Human rights Commission. How can one’s attitude be different when one acts as Chairman of the Human Rights Commission and when the same person acts as Chairman of the Commission of Inquiry? It’s a question of mindset and attitude. The moment any investigator says that he condemns excessive use of force on the protestors and that opening bullets on unarmed protestors even if they are pelting stones is unjustified, it indicates the investigator’s approach to the issue under reference.
Conclusion cannot be avoided that the statement of the Chairman of State Human Rights Commission had created serious doubts in the public mind and that it will be extremely difficult for him to justify what he told the correspondent after becoming Chairman of the Commission of Inquiry.
It needs to be noted that certain vested interests in and outside the establishment in the communalized and radicalized Kashmir have been carrying on a vilification campaign against the security forces and accusing them of violating “human rights of the innocent civilians” since years They are being accused of going berserk; they are being accused of “firing above the waist with the intent of killing innocent”; they are being accused of “killing innocents at will.”
The last few months have seen these vested interests, including some so-called mainstream leaders, separatists of all varieties; “human rights” activists; “opinion-makers”; every Tom, Dick and Harry; and who not, denouncing the soldiers and CRPF personnel in downright language and accusing them of “perpetrating barbarities” on the “innocent” and “unarmed” Kashmiri civilians, including women and children.
It’s no wonder then that the soldiers and the security forces personnel always remain under the constant threat of a murder case against them all the time. And, still our soldiers and CRPF personnel are accepting their posting in Kashmir because they are disciplined and committed to obeying the government orders. They do a splendid job, work very hard and discharge duties for 17 to 18 hours a day and yet they always remain at the receiving end.
None has ever taken any cognizance of the fact that the unruly mobs comprising hooligans and instigated and motivated women with small kids with them had repeatedly attacked the CRPF personnel and their bunkers, pelted stones (read sharp-edged boulders) on the CRPF personnel and did everything that could provoke them to take action in self defence. Nor would any one takes note of it in the future as well because taking cognizance of the activities of the unruly mobs would mean the defeat of the Kashmiri separatists who have been playing politics over the dead bodies.
On the contrary, the vested interests, including those in the government who are responsible for the maintenance of law and order and at whose behest the CRPF personnel were deployed or redeployed to take on unruly mobs and maintain peace, have consistently approached the Government of India and demanded stern action against the alleged “violators of human rights” in Kashmir.
Everyone knows that situation in Kashmir between June and September, 2010 was very complex. Everyone, including those in the administration, knew that the CRPF personnel had exercised utmost restraint despite grave provocation. Between June and August, about 1,000 CRPF personnel had received injuries, some of them very fatal. Despite all this, the CRPF personnel maintained restraint. They had never been trigger-happy. Had they been trigger happy, hundreds of Kashmiri protestors would have been killed and injured. Hence, to blame the disciplined CRPF for what has been happening in Kashmir since 1947 is wrong and immoral. (To be concluded)
