`Constitutional amendment must for fresh delimitation in JK’ | | | EARLY TIMES REPORT Jammu, Jan 18 :-Ruling out any role of Chief Election Commission in the demand for delimitation commission, constitutional experts believe that the commission could be set up only after an amendment to Jammu Kashmir constitution. The BJP and Panthers Party (PP) intend to take up the matter in the budget session of the Legislative Assembly. The BJP also has plans to apprise the CEC of the issue. Working chairman Panthers Party, Harsh Dev Singh, said that it was shocking that the BJP ill-informed BJP leaders who met New Delhi’s nominated interlocutors on Jammu Kashmir could not convince them on the issue. He said that section 47 of the state constitution needed to be amended for setting up a fresh delimitation commission.
Dev said that the best course for the interlocutors was to write to the Prime Minister to suggest to the state unit of the Congress and the National Conference leadership to support the amendment bill in the state legislature. “Since the Congress and the National Conference share power at present the Prime Minister could direct the two to secure amendment to section 47 of the state constitution which alone could result in fresh delimitation of the Assembly segments”, he made clear.
Replying a question, Dev said once the Congress and the National Conference decided to table a bill seeking amendment to section 47 of the state constitution, it would received support from the Panthers Party, the BJP and some independents who have been lending outside support to the ruling coalition and that would give the required two-third majority support for the bill.
He was, however, apprehensive of the support from the National Conference to the proposed amendment bill because being Kashmir centric both the National Conference and the PDP continued to be opposed to fresh delimitation that could enhance the number of Assembly seats for the Jammu region. In support of his contention he said the NC and the PDP were opposed to any plan on transferring power from the valley to the Jammu region and against equal devolution of political and financial powers in the two regions. He said it was hence up to the central Government to persuade the Congress and the NC to move the bill for amending the constitution.
