Court awards 7 years RI in rape case

Jammu, Jan: 18 :- The second Additional Sessions Judge Jammu Vinod Chatterji Koul today awarded seven years rigorous imprisonment to Mohan Lal who was facing trial for committing rape for the past seven years.

According to police case that on October 6, 2003 oral report was made by mother of prosecutrix that on the said date at 12 noon her daughter prosecutrix had gone to attend the call of nature towards the bushes near her house. She heard cry of her daughter and on hearing the same she ran towards the bushes. When she reached there she found accused had laid her daughter on ground and had opened her trouser and was raping her and when he saw her he ran away from the spot. She took her daughter to home. Her husband was not at home and they waited for him. On this report P/s Domana registered FIR No. 219 of 2003 for offences punishable u/s 376 RPC against accused Mohan Lal and started investigation and after completion of investigation police presented challan in the court of law u/s 376 RPC against accused.

Today on quantum of sentence, the court after hearing both the sides observed that considering the mitigating and aggravating circumstances of the case as pointed out on behalf of the accused. The punishment provided for the offence under section 376 RPC is imprisonment for a period not less than 7 years but may extend to 10 years or for life. Taking into the account the facts and circumstances of the case, age of the accused and the fact that he has minor children, old aged parents and having faced the trial since 2003, in my opinion sentence of imprisonment for a period of 07 years will be just and proper. With these observations Court awarded seven years rigorous imprisonment and fine Rs 2000/- to the accused. The accused who was present in court sent to jail for serving the sentence. JNF
