| Discrimination with Scientific Assistants Challenged | | HC seeks selection record of 1983 appointee | | EARLY TIMES REPORT
Jammu, Jan: 19 :- The High Court today sought selection record of a scientific assistant appointed in 1983. The order was passed in a petition filed by one Pawan Kumar alleging discrimination by the concerned authority.
The petitioner who works as a scientific assistant in FSL alleged that seniority list on the basis of appointment orders, showing the officials from Kashmir Division, en-masse senior to the officials/ petitioners from Jammu division.
Vacation Judge of J&K High Court Jammu Wing Justice Sunil Hali issued notice to State of J&K through Financial Commissioner Home, DGP J&K, Director Forensic Science Laboratory and Nine private respondents returnable within four weeks.
The court after hearing the petitioner directed that till next date of hearing impugned order dated April 5, 2010 shall not be given effect to, in the meanwhile summoned the selection record of Scientific Assistants appointed in the year of 1983 indicating the merit of the petitioners vis-à-vis private respondents on the next date of hearing.
The petitioner further submitted that Vide Govt order dated October 1, 1983, the petitioners and the private respondents came to be selected and appointed as Scientific Assistants in the FSL. Director Forensic Science Laboratory issued seniority list vide order dated April 5, 2010 by restoring the placement as was done vide seniority list dated June 6, 1992. The impugned seniority list has not been issued on the basis of the merit assessed at the time of selection but has been issued on the basis of appointment orders by placing nine private respondent from Kashmir Division en-massed over and above the petitioners from Jammu Division. The petitioners have been meted out with discrimination and action of the respondents is arbitrary, illegal and uncalled seeking quashment of this seniority list issued on April 5, 2010. JNF
