| Controversy over selection of J&K Cricket Association | | Court disposes off appeal filed by former Selection Committee member | | Jammu, November, 8- On the controversy between the J&K Cricket Association and former Selection Committee, an appeal filed by one of the members of former committee against the order of City Judge Jammu in which the City Judge restrained the former selection committee for causing interference in the selection process Second Additional District Judge Jammu AK Koul after hearing Advocate Parag Sharma appearing for the appellant and Advocate Vishal Sharma appearing for the respondents, disposed off the appeal with the direction that appellant approached the trial court with the grievances which he has projected before this court in appeal and seek the relief as warranted under law. The Trial Court would however make an endeavor to dispose off the application for interim injunction and the application if any make by appellant in terms of Or.39 R 4 CPC, expeditiously in view of the urgency of the matter. Court further directed the parties to appear before the Trial Court. The facts which led the parties to this situation are that J&K Cricket Association filed a suit for permanent prohibitory injunction against the appellant and others, wherein a decree was sought that appellant and his co-defendants be restrained from representing themselves as selectors of the J&K Cricket Association and interfering. Election of the officer bearers of J&K Cricket Association was conducted on April 18, 2006 in the working committee meeting of the Association in which President and Chairman of the Association were elected to streamline the working of the association and also to constitute sub-committees. A meeting of the working committee was held on July 18, 2006 and 9 sub-committees were formed for selection of the teams to participate in cricketing events and appellant who was one of the member of the earlier sub-committee ceased to exist as such and has no right to interfere in the working of the selection committee. The association filed an application for grant of interim injunction; the Trial Court passed an interim restrain order though the impugned order which was subject to objections from other side and was to remain in operation till October 28, 2006, no further order could be passed on the said date as this court called the record.
