The petitioner Jagar Singh seeking CBI investigation and probe into the alleged encounter that took place on November 21, 2010 by Sunil Singh Jasrotia Inspector SHO Miran Sahib.
According to the petitioner who is known to be an encounter specialist, belonging to SOG and S Gurmeet Singh SHO P/S RS Pura obviously with a posse of other police personals but not belonging to P/S Channi Himmat or P/S Trikuta Nagar within whose territorial jurisdiction the encounter took place opposite Satyam Resort Jammu causing death of Rakesh Kumar alias Giri s/o Jeet Raj (Labourer) a youth belonging to a poor family from RS Pura. The petitioner also sought registration of a criminal case against the erring police personnel and compensation to the family of the deceased.
The petitioner submitted that proper investigation of the matter by independent investigating agency is necessary not only for the sake of justice to the family of deceased Giri but also for unraveling the evil designs of the policemen to involve Choudhary Nagar Singh or any member of his family in a false case and unearthing the larger conspiracy not only about involving him on a false charge in the Amandeep Murder case but also about implicating him in some other case and also harassing him, his family and his business irreparably. Truth must come and impartial investigation by the CBI also can make things clear and transparent. The law is settled that where the police itself are involved in any occurrence, the matter sought to be investigated by an independent and impartial investigating agency and CBI is best suited for the same. ---JNF
