3 day judicial remand for JE | | | EARLY TIMES REPORT Jammu, Jan: 21 :- Special Judge Anticorruption Jammu AK Koul today declined the prayer of VOJ for five day police remand of accused Purshtom Sharma, Junior Engineer Marh Block Jammu who was caught red-handed by the VOJ team on January 20, 2011 while accepting Rs 6000/- from the complainant. The court granted Judicial remand for three days and sent the accused to Judicial Lock-up District Jail Amphbala Jammu with the direction to superintendent that he shall ensure his medical check-up immediately as the accused is stated to be anemic and in case his hospitalization is advised by the specialist, he shall be admitted in GMC Jammu. According to the FIR No 1/2011 one Jagbandhan Singh has been allotted a contract for construction of Shamshan Ghat Marata under the direction of MP Madan Lal Sharma in the year 2007. The contractor asked the JE to process the bill for this he demanded Rs 6000/ as bribe. On this, the VOJ registered a case u/s 5(2) J&K PC Act 2006 r/w section 161 RPC and constituted a trap team which laid trap and caught red-handed the said JE while demanding and accepting the bribe money. Today Inspector Manjeet Singh of VOJ who is Investigating officer of the Case moved an application seeking five day police custody. The Court after perusing the CD File produced by CPO VOJ and the medical record of the accused disallowed the prayer of the VOJ. The accused has been booked in case after being caught red-handed along with the bribe amount of Rs 6000/-, he has been arrested on January 20, 2011, the Chief Prosecution Officer VOJ has submitted that certain aspects of the case need to be investigated in the light of facts alleged by the complainant. The Court after hearing CPO and IO observed that the accused had been caught red-handed during the trap; his remand to police custody is not going to serve any purpose because nothing more needs to be done which would require his presence in police lock-up. Court is of the view that the accused cannot be remanded to police custody as there is no necessity for doing so. He is, however, directed to be sent to Judicial Custody for three days. JNF
