Former District Manager SC/ST Development Corp acquitted

Jammu, Jan: 21 (JNF):- Special Judge Anticorruption Jammu AK Koul today acquitted Prem Nath Loni then District Manager SC/ST/OBC Development Corporation Udhampur who was caught red-handed by the Vigilance Organization on September 10, 2002 while he demanded & accepted Rs 1500 from complainant as bribe.
According to the case on September 10, 2002 one OM Parkash complainant submitted written complaint in the VOJ in which it has been alleged that a loan was sanctioned in his favour by the corporation for the purchase of mule one year before but the accused who was then posted as District Manager SC/ST?OBC Development Corporation Udhampur was reluctant to fix the date for sale & purchase of mules and demanded an amount of Rs 2000/- as illegal gratification for taking a follow-up action. On this complaint VOJ registered a case under FIR NO 20/2002 and caught red-handed then Manager and recovered bribe amount Rs 1500/-. After completion of the investigation challan was presented in the Court of Law.
The court after hearing the parties observed that as per the statement of Ravel Singh one of the independent witnesses 50/60 people gathered on spot at the time of trap but none of them has been associated with trap proceedings. Although they could have been the natural independent witnesses and there is no explanation put-forth as to why any one of them has not been associated with the trap proceedings.
Court further observed that there is one more interesting fact which needs reference. Complainant in his cross-examination says that the mule for which loan had been sanctioned in his favour which in fact led to this entire controversy had been received by him 10/15 days before the occurrence. If we believe this version of the complainant then the entire prosecution story gets belied (contradicted). The complainant and the independent witnesses have virtually damaged the prosecution story. Prosecution witness Bansi Lal has been planted to secure the conviction of the accused through a manipulated trap and rest of the witnesses are police officials belonging to Vigilance wing. With these observations Court dismissed the challan and acquitted the accused from the charges leveled against him. JNF
