Court denies bail to Gang-Rape accused | | | EARLY TIMES REPORT Jammu, Jan 24:-The Chief Judicial Magistrate Jammu (CJM) today denied bail to two gang rape accused, Balbir Singh and Purshtom Kumar. According to the police, on January 13, 2011 a police party of P/S Gharota was on Patrolling Duty on a police vehicle when they came across a wailing woman at Baran Khad at about 3:15 PM. The woman told the police that she has been kidnapped by six persons from Bantalab to Baran Khad and gang-raped by all the accused persons. According to the police, all the accused ran away after seeing the police vehicle. It is has been reported that one of the accused Balbir Singh was apprehended by the police party. Later on police produced prosecutrix before the Special Mobile Magistrate Passanger Tax and got her statement recorded u/s 164-A CrPC and arrested the other accused on January 14, 2011 but one of the accused Sohan Lal is absconding. The court after hearing the CPO Pawan Khajuria and counsel for the applicants disposed of both the applications. The court observed that while deciding the application for bail, Court has to take into consideration various circumstances such as the nature and seriousness of the offence, the reasonable apprehension of the witnesses being influenced. The allegations against the accused regarding commission of offence u/s 366/376/34 RPC are of serious nature as the applicants have allegedly kidnapped and gang-rape the prosecutrix. Accordingly the bail applications were dismissed. JNF
