HC stays promotion order of diploma holders | | | EARLY TIMES REPORT Jammu, Jan: 27 :- Vacation Judge Justice Sunil Hali in a petition filed by 17 degree holder engineers presently working in the R&B Dept challenging the promotion of 7 AEEs Diploma Holders to the post of Incharge Executive Engineer, has stayed the Govt order relating to the private respondents. In the petition filed by Ashok Kumar Gadoo & 16 ors challenging the arrangement of seven diploma holders as Incharge Xen in PWD R&B Dept on the basis that the Rules provided for the promotion of to the post of Xen, AEE must be holding degree in engineering and should have eight years of experience for being promoted as Xen whereas diploma holders should have 10 years of service for being eligible for promotion to the post of Xen. Advocate MK Bhardwaj assisted by Advocate Ajay Abrol appearing for the petitioners submitted that adhoc arrangement and stop-gap arrangement have to be made in accordance with the rules from amongst the eligible candidates from either of the categories. The appointments of seven private respondents have been made in violation of the rules and they do not possess 10 years of Gazetted service as AEE in the same branch of engineering. Upon this Court issued notice to State of J&K through Principal Secretary Public works (R&B) Dept and seven promotees returnable within two weeks. In the meanwhile Court ordered that till next date of hearing and subject to objections from the other sides the impugned order (dated January 21, 2011) shall remain stayed so far it relates to the seven private respondents.
