Jammu, Jan: 28 :- The Second 2nd Additional Sessions Judge Jammu, Vinod Chatterji Koul today started recording the statement of prosecution witnesses. The first prosecution witness Deepinder Kour mother of deceased got her statement recorded. In the meantime Court adjourns the case.
Before recording the statement of prosecution witness, main accused in the case Jatinder Singh filed an application seeking deferment of the proceedings in this case on the ground that he intends to move the Supreme Court for transfer of this case.
It is also stated that it would be improper for this Court to proceed with the trial of the case as the matter is sub-judice before the High Court of J&K. Counsel for the accused Royal Singh also stated the same. So for as the other accused are concerned, the counsel appearing for them stated that they do not want to say anything about the same. Special Public Prosecutor has objected the application of accused Jatinder Singh on the ground that there is no such provision permitting the Court to defer the proceedings in the case that too when witnesses is present in the Court as well as in view of the order passed by the High Court in a petition u/s 561-A.
The court considered the application and the submissions made by the Special Public Prosecutor as well as counsel for the accused has fixed the case for recording of the evidence and that application filed by accused Jatinder Singh is an attempt to defer the recording of the statement of the witness. Even counsel for some of the accused is also not in favour of deferring the recording the statement of prosecution witnesses. The grounds taken up in the application are misconceived. It is not permissible to send back the prosecution witnesses and defer the prosecution evidence. The application being misconceived, the case is taken-up for recording of the statement of witness Deepinder Kour Ex-MLC and Advocate and mother of the deceased Amandeep Singh and Court partially recorded the statement of Deepinder Kour and adjourn the same and fixed next date of hearing.
Meanwhile Police has picked up Choudhary Jagar Singh who was on bail in Amandeep Murder case outside Court complex Janipur when he come after attending the Court. JNF
