Allow petitioner to pursue 2nd semester of BDS: HC | | | EARLY TIMES REPORT Jammu, Jan: 28 :- Vacation Judge Justice Sunil Hali in a petition filed by Diksha Sharma, has stayed the order December 22, 2010 whereby the petitioner was not being allowed to sit in the second semester of BDS. The petitioner submitted that under the Dental Council of India regulations, physiology and bio-chemistry is one subject, however, in the rules proposed by the University Jammu these have been shown as two different subjects. Counsel for the petitioner further submitted that petitioner has secured 41 marks out of 100 marks in bio-chemistry and has been declared to have failed in the said subject and she is not being allowed to sit in the second semester of BDS Course. He further submitted that by invoking the draft rules, petitioner’s admission has been cancelled which is contrary to Dental Council of India Regulation, and submitted that if the marks of physiology and bio-chemistry are taken together, petitioner has secured 100 marks out 200 marks. The court issued notice to Vice Chancellor University of Jammu, Chairman Institute of Dental Sciences and Principal Institute of Dental Sciences Jammu returnable within four weeks. In the meanwhile the court stayed the impugned order dated December 22, 2010 so far it pertains to the petitioner. Respondents are directed to allow the petitioner to peruse her second semester BDS Course at her own risk and responsibility. JNF JNF/JANUARY/28/2011/3
