Anticipatory bail denied to Court official

Ramban, Jan: 31 :- Principal Sessions Judge Ramban, Bala Joyti today rejected the pre-arrest bail of Rehmatullah Ganai former Nazir of Court for allegedly tempering with the Date of birth from June 27, 1945 to June 7, 1952. The bail application was rejected with the observation that the facts of the case at hand are more appealing as member of judicial institutions has been alleged to have committed such gruesome crime which only brings slur to the fair name of the institution.
According to the police case FIR No 130/2010 has been registered on the basis of a letter issued by Chief Judicial Magistrate Ramban due to an order passed by High Court, for the commission of offences u/s 474/471/468/466 RPC against the accused-applicant Rehmatullah Ganai S/O Mohd Ishaq Ganai R/O Maligam Pogal, Tehsil Banihal & District Ramban. The accused retired as Nazir in Judicial Department after rendering a service of more than 7 years illegally.
The court after hearing the parties observed he was not a Matriculate though he used a fabricated matriculation certificate in the course of his service. That he produced a Matriculation certificate showing his DOB as June 7, 1952 whereas initially his DOB was recorded as June 27, 1945. that the accused not only tempered his service record but produced a fake Matriculation-certificate, though he has not passed Matriculation; that he has entered into this high profile criminal enterprise the accused-applicant surreptitiously drew his salary for SEVEN YEARS beyond his justifiable & correct Date of Retirement i.e. June 27, 1945, that the accused is still at large after registration of FIR at the instance of Registrar Vigilance, High Court of Jammu & Kashmir; that the investigation is in its infancy on account of the non-availability of the accused. The most disturbing feature of this case, inter alia, is that the accused was in employment of the department which punishes the criminals & those indulging in unlawful & criminal activity. Due to such acts committed by the persons like accused the most pious institution of Justice is not only defamed but the faith of the common man gets eroded and the prestige of entire institution gets lowered in the eye of the people of all walks of life. The offence allegedly committed by the applicant is of utmost public importance & cannot be lightly taken even at this initial stage. On the basis of the documentary evidence collected by the investigating agency and likely to be collected, there is overwhelming evidence against the accused. With these observations Court rejected the pre-arrest bail of ex-Nazir. JNF
