HC dismisses appeal filed by convict | | | EARLY TIMES REPORT Jammu, Feb 2 : Justice J.P. Singh of Jammu and Kashmir High Court, Jammu Wing has upheld the judgment of Sessions Judge Poonch who convicted and sentenced the appellant Inzar Ahmed to undergo 11 years imprisonment in different sections of RPC. Against this order the convict filed appeal which was today dismissed by the High Court. Justice J P Singh after hearing Adv Mohd Arif for the appellant-convict whereas AAG AH Qazi appeared for the state had gone through the judgment of the Sessions Court and also through grounds of appeal and observed that Court does not see any merit in the appellant’s counsel’s restrictive submissions that the offence committed by the appellant in causing death of Mohd Raqib would not amount to culpable homicide not amounting to murder, in view of the part played by appellant in becoming the member of the unlawful assembly and proceeding towards field of the complainant party armed with a sharp-edge weapon that is knife 13 inch long which he actually used in hitting Mohd Raqib causing massive hemorrhage which resulted in his death. Causing injuries with a sharp edge weapon of 13 inches length would certainly attribute knowledge to the appellant that the injury caused would result in death. The applicant is found to have been rightly convicted u/s 304-II for causing death of Mohd Raqib by the Trial Court. With these observations, Court dismissed the appeal. JNF
