‘Blissful ignorance’ or ‘deliberate delay’ ignorance of govt in not seeking CVC clearance ..? | CIC controversy: | | Early Times Report Jammu, Feb 2: Call it complacency or ‘blissful ignorance’, the NC led coalition has exhibited it in the matter of a seemingly rushed up ‘appointment’ of Chief Information Commissioner for State Information Commission without following mandatory procedural steps. The state Governor NN Vohra not giving his assent to the file related to G R Sofi , has only brought embarrassment both to government as also the person recommended for the highly prestigious post. The lapse noticed by the Governor warranting proper procedural steps to be followed is likely to delay the formal appointment of CIC till CVC sends its clearance for the same.
Sources said even though the government may hurriedly send the request to CVC for giving clearance to Sofi’s name, the entire exercise is going to take considerable time as CVC may take its own time in giving its ‘clearance certificate’ for the concerned officer. Now in this particular case Sofi’s clearance has to be sought from CVC because he has all through been a Central government officer and is still in the service. It has only CVC which can give clearance on his antecedents, sources said adding it can now delay the matter by over a month’s time.
The matter has raised many eyebrows as in the normal course any government should , rather is expected to know the steps that have precede final step of seeking Governor’s assent. The experts and observers have it so say that the government should have completed this formality at least in the case of the strong contenders in the list that was there before the high level committee comprising the Chief Minister, Deputy Chief Minister and leader of Opposition, Mehbooba Mufti. As Sofi was probably the only officer from outside the state government service in the list of persons, it wouldn’t have taken much to get certified his credentials in terms of integrity or impeccable character, as desired by the Act as well, before his final selection.
Even as it has been given to understand that the Committee chose Sofi with ‘consensus’, the political and bureaucratic corridors are rife with the rumours that Sofi was essentially the choice of one member of the panel and the two others had to follow, rather submit to the ‘will’ , making it look a consensus decision, this step of getting the ‘clearance’ on his service record was imperative and too obvious to have gone unnoticed by a vigilant government. This is the basic requirement in making high level appointments and the government should have been careful about it before sending the file to Governor. It goes without saying that Governor Vohra is too meticulous and knowledgeable to have left the matter to remain unnoticed in his eyes, which is why he has not given nod to the government request.
The high level selection committee has desired to get the names of the two commissioners through in the next meeting before the commencement of Assembly session. Why did it chose to push the selection of two officers for next meeting is a question which is also drawing all sorts of rumours and speculations. Be that as it may, but this step also seems far fetched in the wake of the present hitch and hurdle. The moot question still remains is this really ‘ignorance’ on part of the government the reason for such a big lapse or a deliberate attempt to further push the matters into delay….?
