HC comes to rescue of selected registrars

Jammu, Feb-05 :- In a bunch of petitions filed by the selected Registrars in GMC Jammu vide order January 21, 2011 were not allowed to join on the verbal direction of Minister for Health, Justice Sunil Hali of J&K High Court Jammu Wing has directed Principal Govt Medical College Jammu that he shall allow the petitioners to join provisionally against the post of Registrars.
In the one of petitions filed by Dr. Sucheta Hans & Ors in which it has been submitted that they are selected and appointed as Registrar in Govt Medical College Jammu vide order dated January 21, 2011 and are required to join on the said posts for further duties within 21 days from the date of issuance of aforesaid order. It is contended that Director Health Services have already relieved the petitioners with a direction to report Principal Medical College Jammu for further duties. It is alleged in the petition that Principal Medical College Jammu, however, refused to acknowledge the joining of the petitioners only on the ground that there were verbal directions from the Minister for Health not to allow any Registrar to join against as the same would result into dearth of Assistant Surgeons.
In the another petitions filed by Dr. Ajay Kotwal & Ors in which it has been alleged that Director Health Services issued directions to concerned CMOs not to relieve the petitioners only on the ground that there are directions from the Minister concerned not to relieve the petitioners.
Justice Sunil Hali after hearing Adv Abhinav Sharma and Advocate SS Ahmed for different petitions issued notice to the official respondents returnable within three weeks and ordered that in the meanwhile respondents are directed to relieve the petitioners from the post of Assistant Surgeons and also directed Principal GMC Jammu who shall allow the petitioners to join provisionally against the post of Registrars to perform their duties and clarified that this order shall however be subject to objections from other sides.
