DB allows withdrawal of LPA seeking CBI enquiry

Jammu, Feb-7 :- A Division Bench of J&K High Court Jammu Wing Dr. Aftab H Saikia Chief Justice and Justice Mansoor Ahmed Mir has permitted to withdraw the LPA filed by Puneet Chopra s/o deceased RB Chopra.

The Court after hearing the parties observed that the applicant has filed this application permitting him to withdraw LPA. Senior Advocate Sunil Sethi has submitted that after the disposal of the connected writ petitions, impugned order passed has been challenged in this appeal. The Govt of Jammu & Kashmir has constituted a Special Investigating Team (SIT) headed by Farooq Khan DIG of police Jammu conduct further investigation. He has also categorically mentioned that the investigation initiated by SIT has created a hope in the mind of appellant that they will unearth the truth as regard to the conspiracy behind the crime in question and complete the investigation with utmost expedition. The applicant has specifically spelt the reasons for withdrawing appears in the appeal in the application. Upon this DB further observed that in consideration of the submissions, this CMPs stand granted and appellant is permitted to withdraw the LPA and dismissed the LPA as withdrawn.

It is worth mentioning here that on September 18, 2006, some unidentified persons after gaining entry in the house of Rajinder Bushan Chopra alias Raju Chopra with criminal intention at sector 3 Trikuta Nagar have brutally murdered him, his wife Madhu Chopra, daughter Saloni Chopra, Servant Sonu and driver Jagan Nath, after their hands and legs were tied mouths gagged. It was also mentioned in the challan that cash of Rs 56, 11, 384/- was looted. The challan was presented against eight accused who were arrested on different dates in the year 2007, 2008 u/s 302/396/201 RPC and two accused namely Kiran Pradhi and Sangram Singh who are absconded whereas Sangram Singh was arrested by Guna Police and produced him before Principal Sessions Judge Jammu on August 2, 2010. With the direction of the Court, Guna Police handed over Sangram Singh to Jammu Police.

Puneet Chopra son of deceased RB Chopra filed a petition in the State High Court seeking CBI probe in the murder case of his family, State High Court has dismissed the petition on May 1, 2008. Aggrieved by this Puneet Chopra filed this LPA in the State High Court and now has filed CMP for the withdrawing the LPA which was allowed by the Division Bench. JNF
