Govt to face tough resistance for not implementing Constitutional amendment

JAMMU, Feb 8: Though the State Government will announce the dates for the Panchayat and municipal corporations elections in the state in the Cabinet meeting scheduled to be held tomorrow, it will likely face a stiff opposition from various opposition parties for not implementing the Indian Constitution’s 73rd and 74th amendment in the State.
The State Government has already ruled out the implementation of the Constitutional amendments in the J&K with the plea that its own Act is much more better in nature and it is totally flawless. However the opposition parties especially BJP and national Panthers Party will press hard their demand regarding the implementation of the Constitutional amendment. Besides these two aprties the Samajwadi party, BSP, Shiv Sena and other small organisations of Jammu region are also pressing hard for the implementation of constitutional amendment to make the basic democratic institutions more vibrant in the state.
Though Congress which is a coalition partner to NC too had earlier pressed for the implementation of the Constitutional amendment and Prime Minister Dr Manmohan Singh during his visit to udhampur two years back had also stressed on implementation of the Constitutional amendment making the democratic institutions more strong at grass root level. It may be recalled that the State Government had lost central assistance of Rs 250 crore last year to be spent for the development due to non constitutions of panchayats last year. So any further delay in this regard will put the l Government to further loss, sources said.
BJP and other political parties which have forcefully made the demand earlier have criticised the state Government for showing reluctance in implementation of constitutional amendment. Criticising the State Government for claiming that its own act is much more better than the 73rd and 74th amendment, a senior BJP leader said that there is no provision for election of chairman at district level in the State law while in the Central amendment instead of nomination the Board members are elected through secret ballot.
The 74th amendment gives elaborate powers to Local bodies including municipalities while the
J&K Act has no such provision. Under the Act there is no provision of Election Commission to Local bodies nor make elections to the post of district level chairmen to Panchayats.
Lambasting the government for going ahead with local bodies and Panchayat elections the BJP leader said that state government is not interested in holding the elections but it is hurrying the process to grab central assistance of Rs 500 crore which the Rural development Department is likely to get as central assistance for development.
Criticising the Congress and its dubious role he said that the party has totally backtracked from its promise. The number of Panchayats is more in Kashmir than Jammu and the Congress party has failed to bargain on this account thereby playing with the cause of Jammu, he added.
