Dowry death case | Court acquits Husband, others | | Early Times Report JAMMU, Feb 8 (JNF): Third Additional Sessions Judge Jammu Pawan Dev Kotwal acquitted Madan Lal husband of deceased Sunita Devi, Parkasho Devi mother-in-law of deceased and Kunti Devi, sister-in-law of deceased who are facing trial in dowry death case for last seven years as prosecution failed to prove its case. 3rd Additional Sessions Judge Jammu Pawan Dev Kotwal after hearing both the sides raised doubt over credibility of witnesses and consequently dismissed the prosecution story. He said that prosecution evidence establishes that immediately after occurrence, accused shifted deceased in burnt condition to the nearest hospital at Akhnoor and then on reference, to GMC, Jammu. Court questioned that had accused been harassing the deceased and ultimately responsible for the occurrence, they would not have shifted the deceased to hospital immediately and even if, they did so, because of any reason, they could have avoided passing of information to his in-laws knowing the consequences that the deceased was still alive when his in-laws reached the hospital and she could have implicated the accused persons. Court added that circumstances make out the defence of the accused more and more probable. It added that it is of the considered view that prosecution has failed to prove charges against the accused beyond every shadow of doubt. Hence, court dismissed the Challan and acquitted the accused persons of the charges leveled against them.
