DB closes litigation filed by appellants after 33 yrs

Jammu, Feb 10: Division Bench of the High Court comprising of Justice Dr Aftab H.Saikia, Chief Justice Mansoor Ahmed Mir has finally set at rest the litigation by an appellants who are in the possession of the land measuring 14 kanal at village Kathal Dhangu Mohra Punna Tehsil Ramnagar.
It is pertinent mentioning here that Rashma Bibi D/o Late Shukar din was the only surviving member of the family of Late Shukar din who had died along with all other members of the family during the holocaust which followed partition of Indian Sub-continent year 1947.
Reshma Bibi was minor and unmarried at that time as could not cultivate and manage the property left by her father. She was married to Karpal Singh R/o Batala and later on in year 1978 got the land mutated in her name in the Revenue record. The occupant who were in possession of the land started litigation and dragged Reshma Bibi all the time before judicial and quasi-judicial forums right from 1978 till date.
Division bench after hearing counsel R.S.Pathania for the appellants and Amrish Kapoor Advocate for Resham Bibi and A.G. Sheikh Advocate for Custodian Department has finally delivered the judgement which has finally set at rest the litigation after more than 33 years.
The Division bench directed to cause proper and effective implementation of the judgement passed by the special tribunal in year 2007 in the favour of Reshma Bibi at the earliest possible in any case within a period of 90 days from the date judgement i.e. February 10.
