| HC decides controversy over change of courses | | | EARLY TIMES REPORT
Jammu, Feb-11 :- A Division Bench of J&K High Court decided a controversy over the change of courses of the candidates from MBBS to BDS and BDS to MBBS. The two LPAs filed by BOPEE and Alisha Kour aggrieved by the judgment of Single Judge dated July 14, 2010, in this significant judgment Division Bench dismissed both the LPAs.
The petitioner Alisha Kour selected under sports category for the admission to MBBS Course and one Umar Jan Mir claiming to have outstanding proficiency in sports whereas five seats were reserved for the sport category out of 249 seats available for MBBS.
Alisha Kour was selected for MBBS course under sport category and the Umar Jan Mir did not find place in select list and Umar Jan Mir approached the BOPEE with a representation the BOPEE notified the selection of Umar Jan for admission to BDS Course, the Jan was not satisfied his admission to BDS Course, he again approached the BOPEE insisting that he had superior merit against the Alisha Kour. Ultimately Umar Jan filed a petition seeking setting-aside the admission of Alisha Kour. The Writ Court directed BOPEE for allocating appropriate disciplines to the two candidates on the basis of their merit. Aggrieved by the judgment Alisha Kour and BOPEE filed two LPAs which was dismissed by the Division Bench. JNF
