| HC against changing hold cadre of an employee | | | EARLY TIMES REPORT
JAMMU, Feb 14 : State high court today directed army authorities to restore cadre of an army officer who was a member of the architect wing of the army.
Justice Muzaffar Hussain Attar after hearing Adv B.S.Salathia appearing for the petitioner and Adv N.A.Choudhary for the Union of India observed that cadre of the employee cannot be changed in breach of statutory rules of the government order/ instruction issued without putting him on notice.
Court directed respondents to post the petitioner anywhere in his cadre of service in accordance with mandate of communication dated Dec 28, 2006. It stressed that if any post is added to the cadre of service, petitioner can be posted on the said post and if the same is commensurate to the rank of the petitioner who is a Major.
With these observations court disposed of the petition. In a petition filed by Major Daljinder Singh who was a member of Architect wing of Army and was not registered as architect in terms of Act, he has stated that his cadre was changed and he was posted as senior barrack store officer and was accordingly posted as BSTEO.
