Sham serves legal notice to newspaper, says contents of news story defamatory, baseless | | | Jammu: Terming the contents of the news item published on February 10 as baseless, far from truth ,misleading and defamatory, Minister for Health, Horticulture and Floriculture, Sham Lal Sharma has served a legal notice to the editor, reporter and management of a local daily seeking clarification of his name within five days that the contents were not directed against him. The notice served also stated that if the news paper fails to respond, the minister would go ahead with prosecution under criminal law and also claim damages to the tune of Rs. 10 crores (Rs. Ten Crores) for publishing, what has been termed in the notice as " malicious, misleading and defamatory news-item". Sham Lal Sharma in a statement issued here today, has revealed that a legal notice has been served upon the respondents for publication of a news story captioned which, he alleged, has been carried with the ulterior motive of harming his political and social image/reputation . He has sought publication of clarification on the front page of the newspaper that the news item is not directed towards him within five days after the receipt of the notice. Contending that news story was intended to defame him and malign his reputation, the Congress minister has said that it has caused immense harm in reputation besides mental harassment. The notice stated that Sham Lal Sharma is a senior leader of Indian National Congress and has devoted his life time for public cause, social justice, upliftment of downtrodden and equitable development of all sections of society in the State of J&K. It further said Sharma was elected as a Member of Legislative Assembly of the State of J&K and is at present serving as Minister for Health, Horticulture & Floriculture in the State Cabinet. Describing the Congress minister as a self-less leader with a clean image in his long unblemished political life-span , it contends that he has a great repute in society and amongst masses both in the State of J&K and outside. The contents of the notice further read that Sham Lal's elder brother is also a senior Congress Party leader and is a respected Member of Parliament and political figure of repute in and outside J&K.The notice stated that in case of omissions in response from the respondents in terms of clearing the name of the minister from the allegations, the latter would not hesitate to get proceedings initiated under law and also claim damages. It may be mentioned in the said news item has referred to alleged land encroachments along Pallanwala, Akhnoor, Patta Paloura, raising of several commercial complexes, farm houses and misuse of funds by 'two senior Congress leaders, who are part of one family' The legal contents of the notice read as -" That your story above referred, as widely circulated by you in public, is being taken as directed towards my client qua the allegations of land encroachment/misuse of official funds etc, levelled by you through your newspaper. The imputations in the story so published by you in your newspaper referring to senior Congress leader, it is forthcoming, are directed towards my client, and being defamatory, these imputations are aimed at harming the reputation of my client in public….." |
