DC Samba sitting over enquiry | Agrarian land illegally transferred to industrialist | | EARLY TIMES REPORT JAMMU, Feb 14: Deputy Commissioner Samba for reasons known best to him is sitting silently over the application of an aggrieved state subject who agricultural land has been illegally sold to an industrialist. The aggrieved is Suhail Gupta son of Rajesh Gupta, a resident of Trikuta Nagar. According to Suhail's application which is lying in the office of Deputy Commissioner (DC) Samba, his grand father Ram Dass Gupta had bought a piece of land measuring 14 Kanals and 6 marla Khasra number 315, Khata no. 146/78, Khewat no. 7 for agricultural purposes from one Baisakiram son of Jagoo Lohar, a resident of village Meen Sarkar in Samba district. Suhail has further alleged that finding the price of land escalating, legal heirs of Baisakiram namely Sansaro Devi, Bishan Dass, Satpal, Sardari Lal, Raj Kumar, Jeeto Devi, Sudesh Kumari, Sarishta Devi and Veena Devi sold the same piece of land illegally to a non-state subject who is using the same for commercial purpose for setting-up an industrial unit by the name Hindustan Pencil Limited (HPL). Gupta has further said that the land has been transferred to HPL through an illegal lease deed vide mutation number 118 dated 3-4-2002 of village Meen Sarkar, tehsil and district Samba. According to Gupta, the land was sold without their knowledge. "They have neither returned our money nor given us the land in question. Original papers of the land are still lying with us," adds Gupta. He has asserted that land in question was agricultural land and hence, going by the law of land, the same cannot be used for any other purpose. Gupta has further disclosed that the land is being used illegally while the government is sleeping over the issue. He has said that land in question cannot be changed from agriculture to commercial purpose without the written permission of Minister for Revenue as prescribed under Section 13 (1). Further, those violating the act are to be penalized and land under question be vested to the state under agrarian act-1976. However, as per the records, despite blatant violation of agrarian act, government is sitting silently over the issue. Minister for Revenue Raman Bhalla had instructed Deputy Commissioner Samba to hold enquiry and submit the detailed report within shortest possible times vide letter dated 20-02-2010. DC Samba had further asked Tehsil Settlement Samba to verify the same and submit report at the earliest. However, nothing happened. Sources said that the enquiry died its own death and the file was consigned to rot in the almirah of DC Samba. The aggrieved are moving from pillar to post but to no avail. Despite repeated attempts, Deputy Commissioner (DC) Samba could not be contacted. |
