LC Secretary appointment row | CS seeks CM’s intervention | | EARLY TIMES REPORT Srinagar, Feb 15 : The Chief Secretary today sought Chief Minister’s intervention in a row involving appointment of Secretary to Legislative Council. The controversy came to fore when the Deputy Chairman of the Council turned down the cabinet order last week in which Muhammad Sayeed Shah was appointed as Secretary for the post. Sources told a local news agency that the Chief Secretary took serious note of the issue and brought it into the notice of the Chief Minister. Ina letter addressed to the Chief Minister, he sought his intervention in implementing the cabinet order. The row, sources said, has adversely affected the functioning of the council following seizure of accounts by Shah. “Even stationery itms and fuel for vehicles is not available”, they said. Shah, an officer of Legal Gazetted Service cadre and also Registrar State Information Commission, was formally appointed as the Secretary to Legislative Council vide a cabinet decision no 39/Cir/2011 dated 7/2/2011. A formal order No 486-LD (PAB) of 2011 dated 8.2.2011 to this effect was also issued by the Law Department. But, sources said, the Deputy Chairman of the Legislative Council Arvinder Singh Micky didn’t allow Shah to assume the charge on the grounds that an official was already working on the post. The said official, sources said has been appointed in violation of recruitment rules. According to the rules, the secretary can be appointed by the government. Pertinent to mention Rule No.7 of the Legislative Council Recruitment Rules make it clear that neither the Chairman nor the Deputy Chairman of the Legislative Council can appoint an Under Secretary, Deputy Secretary or Additional Secretary and that these powers were only vest with the government.
