HC upholds selection made by SKUAST

Jammu, Feb 16 : The High Court today upheld selection made by the SKUAST in a petition filed Lalit Sharma and Ors who were engaged as Field-cum-Laboratory Assistants (FCLA) and computer assistant engaged on adhoc basis for a period of 89 days and later on extended from time to time with one days break on the expiry of said period.
The respondent issued notification dated February 15, 2008 invited applications for filling-up different posts including FCLAs and Computer Assistant. The petitioner also applied and appeared in the interview. The select list came to be issued on March 11, 2010 in which the petitioner’s name did not figured; aggrieved by non-selection challenged the same on various grounds.

Justice Sunil Hali after hearing the parties observed that it is not in dispute the state is bound to devise some procedure to short-list the candidates considering its limited resources to restrict from appearing in the interview. Short-listing process is adopted only for the purpose of cutting down the zone of consideration to minimum and allowing only those candidates who have been qualified to be considered for selection. The petitioners along with other persons appeared in the preliminary examination and petitioners qualified the written examination and called for interview along with other candidates. Court referred various judgments of the Apex Court and further observed that no error has been committed by the respondents in making selection. Moreover, it is seen that the petitioners were called for interview and they accepted this criteria before appearing in the said interview. Therefore, their rights have not been taken away by the respondents in this behalf. With these observations Court find no force in this petition and dismissed the same. JNF
