| Court awards 4 years imprisonment to ASI | | | EARLY TIMES REPORT
Jammu, Feb-21:- Special Judge Anticorruption Jammu AK Koul today awarded four years imprisonment and fine Rs 10,000 to Bharat Bhushan then posted ASI in P/S Bus-Stand Jammu who was caught red-handed by the VOJ on November 20, 2006 while demanding and accepting Rs 5000/- from the complainant Kulwant Singh.
In the 41 pages judgment Special Judge Anticorruption Jammu AK Koul after hearing CPO Mr. Purshtom Sharma with Senior PO Parshant Mahajan for the VOJ whereas Advocate Rahul Pant appearing for the accused observed that on the basis of facts and evidence on record the guilt has been established against the accused convincingly through legally admissible evidence. The accused has abused his official position and obtained pecuniary advantage other than legal remuneration as a motive to extend favour to complainant in the investigation pending against him and the omissions and commission on the part of accused amount to offences u/s 5(2) r/w 5(1) (d) of PC Act 2006 and section 161 of RPC.
While convicting the accused Court further observed that the accused has faced the Trial for a long period and is a middle aged man. The harsh sentence would on the one hand lead accused to so many miseries and the other hand would also tend to expose his family to a lot of agony and trauma that being so court feel in view of facts read together with other circumstances a lesser sentence would service the ends of justice so convicting accused u/s 5(2) (1) (d) of J&K PC Act sentence him to imprisonment for a period of two years and also to file Rs 5000/-, u/s 161 RPC Court awarded punishment for a period of two years and fine Rs 5000/- Court said that both the sentences would run concurrently.
