JDA Double Murder case | HC stays Parole order Gandharv Singh | | EARLY TIMES REPORT Jammu, Feb-21:- The High Court today stayed parole order of one of the accused in JDA double murder case. The order was passed on a petition filed by one Devinder Gupta challenging the Parole order by IG Prisons inn favour of Gandharv Singh. The trial court has already awarded life imprisonment and fine to the tune of Rs 50,000 to the accused. Justice Sunil Hali after hearing the parties stayed the order of Parole passed by IG prisons and directed Gandharv Singh that he shall surrender before the IG prison forthwith who shall take him custody till further orders. While staying the parole order, Justice Sunil Hali observed that it is contended that Gandharav Singh convicted by the Court for offence u/s 302, 307, 326, 109 and 34 RPC and reference is pending before the High Court for confirmation. It is brought to the notice of this Court that for seeking this bail Gandharv Singh relied on forged medical documents. On this, then Principal Sessions Judge Jammu vide his order dated May 5, 2003 has forward the order along with a copy of application to SSP Crime Branch Jammu for registration of case. IG Prisons has passed impugned order u/s 3 & 4 of J&K Code of Conduct Prisoners (temporary release) Act 1978 and released the Gandharv Singh on parole. This order does not bear any date, it is further contended that Gandharv Singh is convicted by the Trial Court and his conviction is yet to be affirmed by this Court under the fact and circumstances, and he is not eligible to be released on parole. The order also does not disclose the reason on the basis of which the same has been passed. Court issued notice to the respondents and stayed the parole order. JNF JNF/FEBRUARY/21/2011/2
