| ‘Working at the instance of ISI Pakistan’ | | Court awards 22 years imprisonment to four militants | | Jammu, November, 11 Principal Sessions Judge Jammu Mr. Subhash Chander Gupta today awarded 22 years and 6 months RI to four militants working at the instance of ISI of Pakistan namely Altaf Ahmed, Mohd Azad, Jahangir Hussain, Ikhtiar Ahmed all residents of Village Fazalabad, Tehsil Surankote District Poonch and declared Janat Gul Commander Hizbul Mujahdeen r/o Pakistan and Khalid Javid s/o Ghulam Farid r/o Surankote as the conduit and proceedings u/s 512 CrPC initiated. According to the prosecution case the accused Jahangir Hussain had hired a room in village Fazalabad in Tehsil Surankote, where some arms and ammunition was dumped. Accused Altaf Hussain, Mohd Azad, Ikhtiar Ahmed and Jahangir Hussain in league with each other are involved in terrorist activities to cause terror in the area by kilingl the people. On receipt of this information FIR NO 35/1999 was registered and the house of Jahangir was raided and in a moment a blast took place inside the room and three persons who tried to run away from the house were injured. The persons apprehended were identified as Altaf Ahmed, Mohammed Azad and Ikhtiar Ahmed and were taken to Surankote. On the search of the room explosive material was recovered. The accused were interrogated, during the interrogation, they disclosed the involvement of accused Jahangir Hussain, Khalid Javid, Janat Gul Commander HM. Accused Bashir Ahmed was also apprehended and a paper slip having some endorsement of Zabir Aslam Commander Harkat-ul-Ulmas was recovered from the possession of accused Mohammed Azad. Accused Altaf Ahmed made a disclosure, which led to the recovery of rocket MD/107 M. All the accused were sent to interrogation and during interrogation it was revealed that they were involved in the FIR 182/1999 and 15 of 1999. Accused Mohammed Azad disclosed that he had obtained Rs 10,000/- from Janat Gul Commander HM for causing blast in Surankote, which was deposited in the bank and seized. Principal Sessions Judge after hearing Public Prosecutor Mr. E A Tak appearing for the state and Advocate Mohammed Aslam Bhat appearing for the accused persons observed that with the volunteer confession of guilt made by the accused, it is amply proved that the accused were in possession of explosive material and were preparing the explosive devices meant for destabilizing the Jammu and Kashmir Government, established by law and were working at the instance of ISI (Intelligence Agency of Pakistan). The offences u/s 3 Enemy Agent Ordinance, 7/25 Arms Act and 120-B RPC are proved against the accused Altaf Ahmed, Mohammed Azad Jahangir Hussain and Ikhtiar Ahmed. Accordingly the accused persons convicted for the commission of offences punishable under the sections mentioned above. Court after looking to the facts and the circumstances of the case as the explosion had taken place at a time when the accused were in process of making the explosive devices and was not at the stage of its use and it was in the bud when the explosive was detected and recovered from their possession, as such Court considered seven years nine months rigorous imprisonment and fine of Rs 5000/- u/s 3 EAO, rigorous imprisonment for seven years and fine Rs 2000/- for the offence 7/25 Arms Act and rigorous imprisonment of seven years nine months u/s 120-B RPC sufficing to meet the end of justice. Accordingly accused Altaf Ahmed, Mohammed Azad, Jahangir Hussain and Ikhtiar Ahmed are sentenced to under go rigorous imprisonment mentioned above and all the sentences shall run-concurrently, the Court ordered. |
