Can Major Avtar Singh skip civil trial? | | | Early Times Report Jammu, Mar 2: Even if Major Avtar Singh who is wanted in Jaleel Andrabi murder case is extradited from US and brought to Srinagar, he still can skip trial in a civil court. According to noted lawyer and renowned human rights defender, Parvez Imroz, if Major Avtaar Singh is produced before the court in Srinagar, he has an option to skip the trial. “All he has to do is to tell the court that he is interested in court martial. Once this option is exercised the civil courts would cease to have jurisdiction.”In such an eventuality, the erring Major shall be court martialed and even punished. But, this is not what Jaleel’s relatives want. They are interested in a trial conducted by a civil court. Imroz said the court martial verdict can be challenged in a superior court. But this does not seem to satisfy the anxious relatives. The relatives, people close to aggrieved family said, have been putting up a brave front against odds for the past fifteen years. Major Avtaar Singh is accused of arresting Jaleel Andrabi, a noted lawyer and jurist on March 8, 1996 near his residence and subsequently subjecting him to extra-judicial execution. The whereabouts of Jaleel were not disclosed to his relatives. On the contrary his body was fished out from Jehlum on March 27, 1996. The Bar association filed a petition in the High Court seeking constitution of a special investigating team. The prayer was granted. However, Major could not be traced out despite hectic efforts. The erring Major was arrested in US last week for a domestic dispute. Reports said his wife got him arrested and also revealed vital information about him to the US police. A police team from Jammu Kashmir is already in New Delhi. The team is hopeful of bringing Avtaar to Srinagar once he is extradited from US.
