HC directs DC Kishtwar to probe

Jammu, March-05 :- In an interesting petition challenging the selection of ReT teacher for new primary school Baintha on the ground that Village Baintha did not have requisite population of more than 300 souls which would entitled the respondents alone to seek selection. In this regard two certificates issued by Tehsildar Paddar in which Tehsildar indicated that there were 311 souls in Morha Baintha. The other certificate issued by BDO Paddar indicated that Baintha was having less than 300 souls.
Justice JP Singh observed that in view of the contradictory certificates relied upon by the contesting parties to support their respective view point as to the actual strength of the souls in Morha Baintha. The controversy raised in the petition can be resolved only after having a factual report in the matter as to how many souls were there when the two available vacancies of ReT Teachers were advertised for selection. Court directed Deputy Commissioner Kishtwar to conduct an enquiry into the matter and informed the court by the report based an actual facts as to how many souls were there in Morha Baintha on the day when the notification for engagement of ReT teachers for new primary school Baintha was issued. Court also observed that petitioners and respondents shall enjoy liberty to place such material of evidence on which they may chose to rely upon to project there respective case on the issue in question before the Deputy Commissioner.
