Frame rules for appointment in PCB, HC directs State | | | EARLY TIMES REPORT Jammu, March-05 :- In a petition seeking direction to the official respondents to discharge their statutory duties as till date, they have not framed the rules governing the mode and manner of Recruitment for the appointment of Member Secretary and Regional Director of State Pollution Control Board in terms of Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981. According to Advocate Abhinav Sharma the post of Member Secretary is manned by the person who has qualification knowledge and experience with scientific Management of Pollution whereas this chair is being occupied by the officers on deputation basis. According to him this aspect has been taken very seriously by the Supreme Court of India and High Powered committee known as Supreme Court Monitoring Committee. In the petition it was also submitted that J&K Pollution Control Board till date no Rules provide any mode, manner and method of Recruitment to the post of Member Secretary or Regional Director. Therefore, the petition seeking direction to respondents to provide rules and till such rules are not framed, the respondents be directed to discontinue the present arrangement of adjusting the officials of other dept by way of deputation or transfer. Justice Virender Singh of J&K High Court Jammu Wing issued notice to the respondent’s returnable within two weeks. In case the service upon respondents is affected within a week’s time, they shall file response to the main petition within one week; thereafter the main petition is taken up immediately after two weeks. In case reply is not filed by the respondents, despite being served, in that eventuality interim application at least shall be taken-up for consideration, Court observed. JNF
